Introduction to the Terms of Use AgreementOur online store welcomes you and informs you that below, you will find the terms and conditions governing your use of this store and all legal implications arising from your use of the store’s services via the internet through this electronic platform. Any person using the store, whether as a consumer of a service or product from the store or otherwise, agrees to and fully accepts all the provisions and terms of this agreement while possessing full legal capacity according to Islamic law, regulations, and laws. This agreement confirms your commitment to its provisions and regulations. It applies to all types of interactions between the consumer and the store. This agreement becomes effective and enforceable once you accept it and proceed with registration in the store, in accordance with Article 10 of the Saudi Electronic Transactions Law.
Article One – Introduction and Definitions
The above preamble is an integral part of this agreement. Below are the definitions of the key terms used in this agreement:
- (The Store): This includes all forms of the store on the internet, whether an electronic application, a website, or a physical retail store.
- (Consumer): A person engaging in e-commerce to obtain products or services provided by the store via its electronic platform.
- (The Agreement): Refers to the terms and conditions of this agreement, which govern and regulate the relationship between the parties to this agreement.
Article Two – Legal Capacity of the Consumer
- The consumer acknowledges that they possess full legal capacity under Islamic law and regulations to engage with the store or that they are at least eighteen (18) years old.
- The consumer agrees that, in case of violating this article, they bear full responsibility for such violation in relation to third parties.
Article Three – Nature of Obligation
- The store’s obligation towards consumers is to provide the (service or product).
- The store may offer additional services such as after-sales services or other related services, depending on the nature of the (service or product) requested by the consumer.
Article Four – Usage Regulations
- The consumer commits to using the store’s electronic platform in compliance with public morals and applicable regulations in the Kingdom of Saudi Arabia.
- The consumer commits not to use any purchased service or product from the store in violation of public morals and applicable regulations in the Kingdom of Saudi Arabia.
Article Five – Accounts and Registration Obligations
Upon applying for membership in this store as a user, you are required to disclose specific information and choose a username and a secure password to access store services. By doing so, you agree to:
- Be responsible for maintaining the confidentiality of your account information and password and immediately notify the store of any unauthorized use of your account information or any security breach.
- The store will not be liable for any direct or indirect material or moral losses resulting from the disclosure of your username or password.
- You agree to use your store account or membership personally, and in case someone else uses it, this constitutes proof that you have authorized them to use the store in your name and on your behalf.
- You commit to using the store seriously and honestly.
- You commit to providing truthful, accurate, updated, and complete legal information about yourself during registration and updating your details when necessary.
- Our store is committed to keeping your personal information and contact details confidential.
- If the store determines that you have provided false, inaccurate, outdated, incomplete, or illegal information, the store reserves the right to suspend, freeze, or cancel your membership or account without affecting the store’s other rights and legal recourse.
- Failure to comply with any of the above provisions entitles the store management to suspend, cancel, or block your access to the store services.
Article Six – Electronic Communications and Official Communication Methods
- The parties to this agreement agree that communication is conducted via the email registered on the platform.
- The consumer agrees that all agreements, announcements, statements, and communications provided electronically shall serve as written equivalents and shall be legally binding.
- The consumer agrees to receive communications and notifications concerning this agreement or interactions with the store through general messages broadcast to all consumers or to specific users.
Article Seven – Amendments to the Terms of Use Agreement and Fees
- If any provision or clause of this agreement is invalid or no longer applicable, this does not affect the validity of the remaining provisions, which shall remain in force until further notice from store management.
- This agreement, which may be amended from time to time as necessary, forms the framework for understanding and agreement between the (consumer) and the (store).
- The store may impose fees on certain consumers, depending on the offers, products, or services they request or any state-imposed taxes or fees on the nature of the product or service.
- The store reserves the right to add, increase, reduce, or deduct any fees or expenses in accordance with the provisions of this agreement.
Article Eight – Payment and Settlement Services for Store Transactions
- The store, through its partners, offers payment and settlement services, which may be entirely conducted online via the store’s available payment options or any future payment methods introduced.
- The store commits to setting the price of its products or services according to the prevailing market value.
- The store must provide invoices, receipts, and proof of transactions for all amounts and earnings generated through the store and must issue the consumer a purchase receipt for any product or service.
- The store must comply with recognized accounting standards in its electronic store in adherence to this agreement’s provisions and in alignment with legal, economic, commercial, and regulatory interests.
Article Nine – Intellectual Property
- The store's intellectual property rights are fully owned by the store, whether acquired before or after the establishment of this electronic platform.
- The consumer must respect the store’s intellectual property rights, including its name, logos, symbols, and other displayed elements, as all such rights are fully owned by the store.
Article Ten – Store Responsibility
- The store commits to conducting its business through this electronic platform lawfully and in accordance with the regulations of the Kingdom of Saudi Arabia and the provisions of this agreement.
- The store bears no responsibility for claims arising from errors or negligence, whether directly or indirectly caused by the consumer or a third party, such as shipping companies.
- The store, its staff, owners, and representatives must ensure that the (product or service) is legal, authorized, and compliant with the regulations of the Kingdom of Saudi Arabia and is used for legitimate purposes.
Article Eleven – Access or Membership Restrictions
The store may suspend or cancel a consumer’s membership or restrict their access to the platform's services at any time without notice and for any reason, without limitation.
Article Twelve – Governing Law and Applicable Regulations
This Terms of Use Agreement is governed and drafted in accordance with the laws and regulations applicable in the Kingdom of Saudi Arabia and is entirely subject to the jurisdiction of Saudi Arabian authorities.
Article Thirteen – General Provisions
- If any clause of this Terms of Use Agreement becomes invalid or unenforceable, it does not affect the validity of the remaining provisions, which remain in effect until further notice from store management.
- This agreement, which may be amended from time to time, forms the operational framework, understanding, agreement, and contract between the store and the consumer.
- The Arabic language is the authoritative language for interpreting this agreement.
- All prices listed for store products or services may be modified periodically.
- Promotional or marketing offers provided by the store are temporary and may be altered or discontinued at any time.
- The parties to this agreement commit to interactions that comply with Islamic law and applicable regulations.
- This agreement can only be terminated by a decision from store management.
